TERMS AND SALE CONDITIONS
The products covered by these general conditions are offered for sale by ReImmagina di Nancy Marchini with registered office in via F. All orders or purchases by the Purchaser are governed by these general conditions of sale which the Purchaser expressly and unreservedly declares to accept.
1. Object of the contract
With this contract, the Supplier sells and the Purchaser remotely purchases the products offered on the website www.miamaglietta.com via telematic tools.
2. The various technical steps to follow for the conclusion of the contract
The contract between the Supplier and the Buyer is concluded exclusively through the internet. Once the Purchaser has logged in to the address www.miamaglietta.com , he must follow the procedures reported on the site in order to formalize his acceptance for the purchase of the products referred to in the previous art. 1.
3. Terms of payment
3.1 Any payment for the products purchased by the Buyer must be made solely through the payment methods indicated on the website www.miamaglietta.com . The use of the indicated payment methods does not involve any additional charge for the Buyer.
3.2 Any reimbursement to the Buyer will be credited through one of the methods proposed by the Supplier and chosen by the Buyer in a timely manner and, in case of exercise of the right of withdrawal, at the latest within 14 days from the day on which the Supplier became aware of the withdrawal itself. The Supplier may withhold the refund until the product is received or until the Buyer provides proof of having returned it, whichever occurs first.

4. Delivery times and methods

5. Prices
All sales prices of the products displayed and indicated on the website www.miamaglietta.com are expressed in Euros. Prices are inclusive of VAT and any other tax. The shipping costs will be indicated and calculated by the Supplier in the purchase procedure before the order is forwarded by the Buyer and also contained in the summary web page of the order placed. The buyer who buys products outside the European Economic Community (EEC) is responsible for importing them into the country of destination. 6. Limitation of Liability
6.1 The Supplier will not be liable for delays or failures in the execution of the services against him, if caused by unforeseeable circumstances and / or attributable to force majeure.
6.2 Furthermore, the Supplier will not be liable for damages, losses and costs incurred by the Purchaser as a result of the non-execution of the contract for reasons not attributable to him, since the Purchaser is only entitled to a full refund of the price paid and any additional charges incurred.
6.3 The Supplier assumes no responsibility for any fraudulent and illegal use that may be made by third parties, of credit cards, checks and other means of payment, upon payment of the purchased products, if he proves that he has adopted all the possible precautions based on the best science and experience of the moment and based on ordinary diligence.
7. Warranty
7.1 The Supplier is liable for any lack of conformity that occurs within two years from the delivery of the goods.
7.2 The Buyer loses all rights if he does not report the lack of conformity to the seller within two months from the date on which the defect was discovered. The complaint is not necessary if the seller has acknowledged the existence of the defect or has concealed it.
7.3 In the event of a lack of conformity, the Purchaser may request, alternatively and without charge, under the conditions indicated below, the repair or replacement of the purchased good, a reduction in the purchase price or the termination of this contract, unless the request is not objectively impossible to satisfy or is excessively burdensome for the supplier pursuant to art. 130, paragraph 4, of the Consumer Code (Legislative Decree No. 205/2006).
7.4 The request must be sent in writing, by registered letter with return receipt or by certified e-mail, to the Supplier, who will indicate his willingness to proceed with the request, or the reasons that prevent him from doing so, within seven days. working from receipt. In the same communication, where the Supplier has accepted the Buyer's request, he must indicate the methods of shipment or return of the product as well as the deadline for the return or replacement of the defective goods.
8. Obligations of the Buyer
8.1 The Buyer undertakes to pay the price of the purchased product within the times and methods indicated in the contract.
8.2 The information contained in this contract has, however, already been viewed and accepted by the Buyer, who acknowledges it, as this step is made mandatory before confirming the purchase.
9. Right of withdrawal
9.1 In any case, the Purchaser has the right to withdraw from the stipulated contract, without any penalty and without specifying the reason, within 14 calendar days, starting from the day of receipt of the purchased product.

9.3 The Supplier will refund the price of the product for which the withdrawal has been exercised within 14 days of receipt of the notice of withdrawal from the Buyer.
10. Resolution
The non-fulfillment of the obligations referred to in Articles 4.5 and 11, assumed respectively by the Buyer and the Supplier, will entail the right of each party to terminate the contract pursuant to and for the purposes of art. 1456 of the Italian Civil Code.
11. Processing of the Buyer's personal data
The Supplier protects the personal data of its customers and guarantees that the processing of data complies with the provisions of the privacy legislation referred to in Legislative Decree n. 196/2003 and the European Regulation 2016/679.
12. Method of archiving the contract
12.1 The Supplier informs the Buyer that this contract can be printed or archived on the Buyer's own devices.
12.2 Pursuant to art. 12 of Legislative Decree 70/2003, the Supplier informs the Purchaser that each order sent is stored in [digital / paper form] on the [server / at the headquarters of the Supplier itself], according to criteria of confidentiality and security.
13. Communications and complaints
Written communications directed to the Supplier and any complaints will be considered valid only if sent to the following address ReImmagina, via F. 14. Jurisdiction and Applicable Law
The exclusive jurisdiction for any dispute is that of the consumer's place of residence or domicile of choice. This contract is regulated by the Italian law.
